After my [and few other LJ surfers] very poor display[s] of Aloha for the past month or so - my attorney suggested that I have all unaccredited surfers who want to surf in the LJ area sign some sort of release, something like the "Disclosure Statement and Application to Ride Wave Loch 'Bruticus Maximus'"

Rough Draft - For Discussion Only:

You are electing to participate in what some deem an "extreme sport," and even though you may be the best surfer at Typhoon Lagoon or Big Surf, you ain't in Kansas any more!

You are now attempting to surf in the geographical area known as La Jolla, CA or "End of the Road Redux."

The incredible combination of violent surf and the mixing of unskilled, semi-skilled, skilled, and professional surfers in the La Jolla, CA area present a very aggressive white water attraction.

If you choose to go surfing in LJ, you may unavoidably, or avoidably achieve body positions that result in personal injury during your participation and attempts at demonstrating your surfing skills or lack thereof [chicks might dig you if you surf].

The tricks, stunts or body positions that you may attempt (or inadvertently achieve) will be based upon your REAL or PERCEIVED physical abilities and skill level.

There is a risk of self inflicted injury or injury caused by others that can result from such tricks, stunts or body positions which exceed your skill level (and which may occur irrespective of your skill level).

For instance, you may sustain injury as a result of slipping on or striking surrounding elements, e.g., ocean bottom, rocks, other wave riding vehicles, entering/exiting surfers or swimmers, boogers, etc.

Additionally, since your own surfboard may contain fiberglass, plastic, wood, metal, or other hard and potentially dangerous materials, contact with them may also cause injury.

Furthermore, if you fall off your board, and your leash breaks, and most importantly, you don't know how to swim, your ride may end with the flow of water picking you up and pitching you head-over heels onto a reef, a Fire Coral head, concrete blocks, Lionfish spawning areas, stingray mating grounds, rip currents, etc.

Potential risks to surfing in La Jolla include, but are not limited to, lacerations, sprains, herniations, torn or wrenched-off body parts, broken teeth, dislocations, drowning, numbness, paralysis, incontinence, sterilization, blindness, deafness, amputation or death.

"Unwritten Surfing Rules" were written by, and for, participants at beaches such as Tourmaline and San-O, when one ventures out of those type areas, one must remember, just as Dorothy did - "You ain't in Kansas anymore!"
